The following Terms and Conditions are agreed to by both you the customer and TradeSitesPro upon first payment. “Check” the “agree to Terms and Conditions” box is your confirmation that you have read, understand and agree to these terms. Any questions will be address via email or contact form.
Both parties agree to :
You or your company are a customer to TradeSitesPro or TSPro for short name. You have the power and ability to enter into these terms and conditions on behalf of your company or organization. You agree to provide us with materials that we need to complete your project including images and other information requested by TradeSitesPro when we need it, in a timely manner and in the format that we agree to.
You agree to review our work, provide feedback and sign-off approval. If there is any misrepresentation of you, your business/organization, whether services you provide, pricing, images or anything you don’t agree to, you must contact us, TradeSitesPro immediately requesting change.
We have the experience and ability to perform the services you need from us and we will carry them out in a professional and timely manner. We will meet all the deadlines set but TradeSitesPro will not be responsible for a missed opening date or a deadline if you have not supplied materials or have not approved or signed off our work on-time at any stage.
Details
We will create a website design for aesthetics and functionality. These terms include one main design plus the opportunity to have our team update your text, photos, videos, promotions, and other necessary content to keep your website current.
If you decide to add additional service areas through Search Engine Optimization (SEO) on your website, additional monthly charge per month for every additional 3 service areas or targets added to your subscription. Please note that your standard subscription will already include up to 3 city/suburb targets. This added monthly charge only applies to businesses who decide to add additional cities to target online as time goes on.
Hourly rates only apply to circumstances that are “above and beyond” our normal services listed within this contract. The rate that will be charged is $80.00 per hour.
Format
If your project includes forms, plugins, scripts, or databases that require outsourcing or third party provider this will be discussed with you via email and if any charges are necessary they will be applied. TSPro offers every function for local trade, contractor service area SEO to market a company. We do not provide databases or pay functions for your customers. Additional functions would be additional charges.
We will test the completed website in current versions of all major browsers. If you need to show the same or similar visual design to visitors using these older browsers, there will be a charge applied at the hourly rate set out in our scope of work estimate for any necessary additional code and its testing.
Subscription Includes
Our websites are built for all devices of up to 20 pages (additional pages can be added based on request and additional charge), local search engine optimization (SEO) or organic searches, setup & optimize Google My Business account, website support, regular minor website changes/content management, website hosting for your actual website, SSL Certificate, & regularly analyze website ranking and stats.
Home page, landing page will be completed and uploaded within 72 hours of subscription purchase. Additional pages, about, contact pages will be uploaded within 72 hours after homepage. Other pages will be uploaded in a timely manner. These pages include “our work”, “careers”, “promotions”, “reviews”, “blog”, “online portal” will be added to website within a timely manner.
We will also provide a standard website privacy policy. This policy does not constitute as legal advice and can be customized with your company details if provided to us. We do not provide a terms and conditions statement, but this can added if provided by your company. Your website will also include an accessibility statement and accessibility tools to allow site visitors better accessibility to your website. The accessibility statement and tools do not constitute legal advice and can also be customized with your company details if provided to us to better meet any law requirements in your target market.
Website subscriptions also includes one landing page dedicated to outside campaigns such as, but not limited to;Google Local Business, Facebook, Google Adwords, etc. We do not manage business calendars, event calendars, employee schedules, customer databases.
Facebook accounts include a business account, updated seasonal promotions, ad campaigns. $25 of monthly subscription fee is designated for paid advertising on Facebook. If both parties agree, the $25 can be held over monthly for larger more expensive seasonal campaigns. Additional funds can be added to Facebook campaigns with additional costs provided by the subscriber.
Google adwords advertising campaigns are also available with additional costs to be provided by the subscriber. Those funds would include the Google Adwords billing and additional work by TradeSitesPro at $80 per hour. Contact us for additional requests.
Text Content
We will prepare the initial text content for your new website if not provided to us. Our team will prepare unique/broad text for up to 20 pages, including the home page, service pages, service area pages, etc. It is your responsibility to carefully review and verify accuracy of text. If changes are required, we will need to be provided specific text changes. We will not be held responsible for any damages/inaccuracy of text content on your website.

Photographs
You are welcome to supply us photographs in digital format. We will use stock photographs as necessary.
On top of this we will also maintain the confidentiality of any information that you give us.
Domain & Hosting
All of our subscription websites must be hosted by our server provider, which is a part of our package. We purchase the domain used in your subscription. If our business relationship end for any reason, the domain name will be transferred to you. You then, will be responsible for future payments retaining the domain if you wish to retain it. You will also be responsible for hosting your domain once our relationship end if you choose.

We can’t guarantee that the functions contained in any web page or in a completed web site will always be error-free and so we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this web site and any other web pages, even if you have advised us of the possibilities of such damages. We will not be held liable for any damages for website content provided including but not limited to: text content you provide such as service guarantees, testimonials, customer privacy policy and accessibility related issues. We will provide a suggested template privacy policy & accessibility tools that do not constitute legal advice or protection.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
Copyrights
You guarantee to us that any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the web site are either owned by you, your company/ organization, or that you have permission to use them.
When we receive your first payment, copyright is automatically assigned as follows: You own the graphics and other visual elements that you provided for this project. You also own the text content whether written by our team or provided by you once it has been published online. You will still be responsible for maintaining the files you provide to us, as we are not required to keep them if you were to ever cancel your service.
You also own text content, photographs and other data you provided, unless someone else owns them. We own the design content, XHTML markup, CSS and other code and we license it to your company/organization for use on only this project when managed by Lawn Care Web Design.
We love to show off our work and share what we have learned with other people, so we also reserve the right to display and link to your completed project as part of our portfolio and to write about the project on web sites, in magazine articles and in books about web design. At no time will we ever share confidential information about your business/ organization and operations.
Website Updates & Requested Changes
Included in your subscription is the ability to request updates and changes to your website as needed. Updates are considered: changes to text and images, promotions, creation of new pages, deletion of pages, and minor changes throughout the website. Updates do not include major changes to a website’s design and structural layout. Changes cannot be sent via text message or directly to your account manager. *All changes/requests must be sent through our support ticket system. From there, they will be added to a queue and handled in the order they were received. All requested changes require at least two business days to complete, but depending on the type of requests, the changes could exceed two business days or take less than two business days to publish. You will receive an automated email when your changes have been published. All changes/ additions to website must be handled by Lawn Care Web Design.
Payments
You agree to stick tight to the following payment schedule, which will be as follows. 100% of the first monthly fee must be paid upon agreement to start designing the company website.
If your website subscription payment is not made on a monthly basis and fall behind more-than 30 days, your website will be unpublished until outstanding balance is paid in full.
You and/or your company/organization has agreed to a $375.00 per month.
Cancellation
This is a month to month subscription and you can cancel your subscription by giving us a 30 day notice by emailing info@lawncarewebdesign.com. Upon cancellation, your website hosting with us will be discontinued, and the website design remains property of Lawn Care Web Design.
If for some reason one part of these terms become invalid or unenforceable, the remaining parts of it remain in place.
Although the language is simple, the intentions are serious and these terms act as a legal document under exclusive jurisdiction of US courts.
